“WizQuiz” Content Subscription

  1. Information on how to enter and prizes form part of these Conditions of Entry. Entry into this competition via SMS is deemed acceptance of these Conditions of Entry by each entrant.
  2. Entry is via SMS only. Entry must be made via SMS (premium call rate applicable) using SMS (short messaging service) enabled mobile phones. Some service providers and call plans may not provide access to premium SMS. Entrants must check with their service provider if unsure.
  3. Entry into a given competition is only open to residents of Australia aged 18 years and over who are identified as having a clear relationship with the end mobile device (evidenced entrants entering by SMS message originating from an MSISDN identifying the entrant) and who successfully subscribe to the Wiz Quiz competition subscription service in the manner required by the Promoter (as set out in Condition 4). The Weekly WizQuiz content subscription services costs $6.60 per week.
  4. In order to subscribe to the WEEKLY WizQuiz competition subscription service, an eligible entrant must, during the promotional period, receive a telephone call from the Promoter and follow the prompts provided by the Promoter in that telephone call to subscribe to the WizQuiz competition subscription service. The Promoter will also send the eligible entrant an SMS confirming their subscription to the WizQuiz competition subscription service within seven (7) days of their subscription. Maximum of 6 message per month can be sent to a subscriber.
  5. Giveaway Each eligible entrant who subscribes into this promotion during the promotional period in accordance with the entry requirements set out above will receive one (1) $60.00 Sports-bet voucher. Instructions on how to claim the gift will be sent to the subscribers by the Promoter by SMS. The vouchers are subject to prevailing terms and conditions of use which can be found at www.sportsbet.com.au under the “Free Bet Section”. The Promoter encourages the responsible use of the gift, in accordance with applicable State and Territory legislation. Gifts are not transferable or exchangeable and cannot be taken as cash. If a gift becomes unavailable for any reason beyond the Promoter’s reasonable control, then a similar gift of equal or greater value will be awarded to the winner in lieu.
  6. This Gift has no monetary value, is non-transferable and cannot be redeemed in whole or part for cash from the Promoter.
  7. The promoter and it’s clients accept no responsibility and in any circumstances be responsible or liable to compensate the purchaser or other bearer, or accept any liability for (a) any accidents or mishaps that occur when using the gift (b) any inability by the claimant to use this gift properly.
  8. Wiz Quiz Content: Members of the Wiz Quiz will receive one (1) x 'Content Credits' via a WAP Push Message, which can be used to redeem one (1) x Content Items from WizQuiz WAP site (polyphonic ring tone, monophonic ring tone, wallpaper or sound FX, Celebrity Gossip, Horoscope or Joke only). As part of the continuing membership of the WizQuiz Mobile Club, subscribers will then continue to receive one (1) x 'Content Credits' via a WAP Push Message, every 7 days, on an on-going basis, until they elect to unsubscribe from the service. To stop a subscription to the WizQuiz Mobile Club, SMS the keyword "STOP" to relevant short code you are being sent message from. This SMS termination request will be charged at 25c including GST. Please note that an SMS message containing any other wording may not discontinue your subscription to the WizQuiz Mobile Club.
  9. Extra Content Items' costs for purchases made by SMS (only): All Content Item costs for purchases made via SMS will be billed to the consumer's nominated mobile phone account as follows: $4.00 Content Item' purchases will be billed to the consumer via 1 x $4 billing message; $8 'Content Item' purchases will be billed to the consumer via 2 x $4.00 billing messages; $12 'Content Item' purchases will be billed to the consumer via 3 x $4.00 billing messages. The SMS purchase request cost and the relevant cost of the 'Content Item' will be charged to your nominated mobile phone account when your initial SMS request message is sent and not at the time the 'Content Item' is downloaded to your mobile phone.
  10. The Service Provider reserves the right to verify the validity of Content Credits and 'Content Item' purchases/downloads and reserves the right to disqualify any consumer for purchasing and/or downloading a 'Content Item' otherwise than in accordance with these Terms and Conditions. The Service Provider's decision is final and no correspondence will be entered into.
  11. Any 'Content Credits', that are not redeemed within 7 days of the relevant WAP Push Message being sent, will expire and will not be redeemable for any 'Content Items'. Expired 'Content Credits' will be forfeited and are not refundable for cash.
  12. No responsibility accepted for lost, misdirected or deleted SMS messages and/or WAP Push Messages.
  13. All WAP Push Messages will be sent to the consumer's nominated mobile phone in each case.
  14. Standard carrier WAP/GPRS charges apply to selecting and downloading any and all 'Content Items', and will vary depending on the consumer's network provider. The consumer is solely responsible for these charges, which charges will apply, whether or not the download is successful.
  15. Any 'Content Items' downloaded from the Wiz Quiz WAP site in excess of a consumer's allocated 'Content Credits', will be charged to the consumer's mobile phone account accordingly.
  16. All SMS request and 'Content Item' costs will appear on the consumer's next mobile phone bill. If a pre-paid mobile phone is used, consumers must ensure that they have enough credit to cover the relevant costs incurred. Consumers must seek the phone bill payer's permission (if the consumer is not responsible for paying the phone bill) prior to purchasing a 'Content Item' and/or subscribing to the Wiz Quiz Mobile Club.
  17. The 'Content Items' available for redemption using Content Credits will vary from time to time (as determined by the Service Provider in its absolute discretion). 'Content Credits' and 'Content Items' are not transferable or exchangeable, cannot be taken as cash.
  18. All 'Content Item' choices are subject to availability and handset/network compatibility. The Service Provider strongly recommends that consumers check their mobile phone handset compatibility prior to selecting a Content Item Type to purchase and downloading any selected Content Item. The Service Provider accepts no responsibility for any incompatible mobile phone handsets.
  19. Response times may vary. If there are any network issues outside of the Service Provider's control, the downloading of the 'Content Item' to the consumer's mobile phone could take longer. To the extent permitted by law, the Service Provider accepts no liability for any loss or damage as a result of delays, non-receipt of a 'Content Item' or any technical problems.
  20. The Service Provider shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained, as a result of receiving the service and/or purchasing/downloading any of the 'Content Items', except for any liability which cannot be excluded by law.
  21. SMS messages sent via the internet are not valid and will not be accepted. All SMS messages are deemed to be received at the time of receipt into the database and NOT at the time of transmission by the consumer.
  22. Wiz Quiz Club Members can also participate in a weekly trivia service. The weekly question will come in the weekly content WAP message. A given competition will commence on the date and time advertised and will close on the date and time advertised and/or advised to each entrant by the Promoter via SMS. The winner will be determined in accordance with Condition 24. (Game of Skill) Winner will be notified by telephone call to the number that their entries were submitted from and their details will be published on www.wizquiz.com.au If the winner is not reached after the Promoter makes two attempts to contact him/her or within a 48 hour period (whichever is later), the Promoter will allocate the prize to the eligible entrant deemed to be in second place (in accordance with Condition 24). If the Promoter is unable to contact that eligible entrant in second place after the Promoter makes two attempts to contact him/her or within a 48 hour period (whichever is later), the Promoter shall contact the eligible entrant deemed to be in third place (and so on) in accordance with the above stated process until a winner is contacted and prize is issued. Promoter’s decision is final and no correspondence will be entered into.
  23. Each given competition consists of one trivia question, which will be sent to all eligible entrants by SMS at the commencement of an advertised competition period. Eligible entrants will be eligible to participate in the competition that commences immediately after the date that eligible entrant subscribes to the competition subscription service. To enter the competition, eligible entrants must, during the advertised competition period, correctly answer the single trivia question posed for that given competition by the close date and time for that given competition by sending an SMS in the required format to 19966664. Eligible entrants will be advised by the Promoter what the required format of the SMS response will be by SMS or other relevant media before the first SMS entry must be submitted.
  24. The eligible entrant who correctly answers the trivia question for a particular competition by the close date and time of that competition in the fastest response time will be deemed the winner of that given competition. To determine which entrant has submitted the “fastest response”, the Promoter will refer to the period of time between each eligible entrant receiving the relevant trivia question and that eligible entrant submitting their correct response to that trivia question. The eligible entrant who submitted their correct response in the shortest amount of time will be deemed the winner. If more than one eligible entrant is deemed to have submitted the “fastest response”, the Promoter shall send the eligible entrants who have qualified as submitting the “fastest response” advising of the tied result and provide the tied eligible entrants with another trivia question. The tied eligible entrant who correctly answers that trivia question in the fastest response time will be deemed to be the winner. The “fastest response” will be determined in accordance with the criteria set out in this Condition 24. If more than one tied eligible entrant is deemed to have submitted the “fastest response” to the additional tie-breaker question, the Promoter will advise the tied eligible entrants of the tied result and provide the tied eligible entrants with another trivia question. This process will continue until a single winner is determined.
  25. Entrants will be advised of the close date and time for a competition in applicable advertising or other media (including but not limited to SMS) for a given competition. The Promoter will also advise the close date and time for a given competition in at least the first SMS communication the Promoter sends to an entrant.
  26. All answers submitted by eligible entrants must be in the required SMS format. Any answers submitted by entrants that are not in the required SMS format will be deemed invalid. The Promoter will advise eligible entrants what the required SMS format for their response will be each time the Promoter poses a trivia question to an eligible entrant.
  27. SMS messages must be sent from a mobile phone handset and be identified by a MSISDN for security reasons (unique mobile SIM number) to be eligible. Any form of automated entry using the Internet or any other device or software is invalid.

  29. Premium SMS cost to enter the competition is a maximum $0.25 (including GST) for each SMS answer submitted by an eligible entrant. Any SMS entries submitted after the competition period has closed will not be included in the competition and will be charged $0.25 (including GST). Total cost to participate in a given competition will be a maximum of $0.25 (including GST). The charges for all SMS entry services will appear on each entrant's next mobile phone bill. All queries relating to mobile bills should be directed to the entrants' mobile or telephone carrier. Incomplete, ineligible or incomprehensible entries will be deemed invalid. No responsibility will be taken for lost, late or misdirected entries. Entries must be received by the Promoter during the advertised applicable competition period. SMS entries will be deemed to be accepted at the time of receipt and not at the time of transmission.
  30. A reply SMS will be sent to each entrant submitting an entry by SMS immediately after their answer entry has been received confirming their entry has been successfully received and advising whether their answer was correct or incorrect. The reply message from the Promoter confirming if the entry has been received and notifying the entrant if they are correct or incorrect is sent at no charge.
  31. Eligible entrants can enter multiple competitions, but may only register for and enter each competition once. Any entry into a given competition beyond their first entry into that competition will be deemed invalid. There will be one quiz each week plus the potential for one additional bonus quiz each month, creating a maximum of 6 quiz's in any given month.
  32. Entrants can only enter in their own name. The Promoter reserves the right to request the winner to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the winners’ identity, age, residential address, eligibility to enter and claim a prize, that the entrant obtained the consent of their parent/legal guardian (where applicable) to enter the competition, the age, identity and residential address of the parent/legal guardian that provided their consent, that the entrant has a clear relationship with the end mobile device used to enter via SMS and any information submitted by the winner in entering the competition, before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the winning entry has not been verified or validated to the Promoter’s satisfaction within the time requested, the winner’s entry will become invalid.
  33. The eligible entrant deemed to be the winner of a given competition in accordance with Condition 24 will win the prize applicable to that given competition. Eligible entrants will be advised by the Promoter what the prize for a given competition will be, as well as the Recommended Retail Price (including GST) of that prize by SMS (when providing eligible entrants with the question for that given competition) and at www.wizquiz.com.au during the promotional period for that given competition. Eligible entrants shall be advised of the prize details for all competitions before they are able to submit an entry for a given competition.
  34. Prizes are not transferable or exchangeable. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. Where applicable, all warranty claims relating to a prize must be referred to the manufacturer, not the Promoter. Where applicable, use of any passes and vouchers issued as a prize is subject to prevailing terms and conditions of use and passes are only valid for use within the stated duration on the passes or vouchers issued. If any pass or voucher is not redeemed within its stated validity period, it will be deemed null and void.
  35. The Promoter will issue prizes directly to the winner. The Promoter accepts no responsibility for prizes lost or damaged in transit.
  36. If for any reason any element of a prize becomes unavailable for any reason beyond Promoter’s control then a similar prize element of equal or greater value will be awarded to the winner in lieu.
  37. Subscribers to the service agree to receive further marketing messages from the promoter in relation to any other service's that are provided by the promoter. 
A maximum of one marketing SMS message will be sent to a subscriber each month.
  38. Entrants can opt out of this competition at any time by sending an SMS with the word “STOP” to 19966664, by contacting the help line on the number below or by logging on to www.wizquiz.com.au and accessing the “support” section of the website. By doing this, entrants will opt out of this competition and any other service offered on 19966664. Consumers may call the competition help line on 1300 730 368 for queries regarding opting out of this competition and queries regarding this premium service.
  39. The Promoter will issue an entrant a refund of its costs to enter a competition where competition mechanics or voting conditions are altered in a material way prior to entry and reasonable steps have not been taken to advise that entrant of those changes. Refunds shall be by way of credit to the entrant’s service account or by cheque (as determined from time to time by the Promoter).
  40. The Promoter and its associated agencies and companies and its employees, servants and agents shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with taking the prize or using the prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
  41. SMS is not a guaranteed delivery communication tool. The Promoter and the service provider cannot accept responsibility for any SMS messages not received.
  42. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with these Conditions of Entry, or if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the competition. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
  43. The Promoter is not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination thereof, or any other technical failures including any damage to entrant's or any other person's mobile handset or computer related to, or resulting from, participation in this competition or the downloading of any materials related to this competition.
  44. If for any reason this competition is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the competition, subject to any applicable legislation, industry codes or schemes.
  45. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this competition if the deficiency is occasioned by any cause outside the reasonable control of the Promoter.
  46. Statutory warranties that are implied under Division 2 Part V Trade Practices Act are not excluded if goods or services are of a kind ordinarily acquired for personal, domestic or household use.
  47. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
  48. Caution: any attempt to cause malicious damage or interference with the normal functioning of the SMS applications, any Promoter’s website or the information on the website, or to otherwise undermine the legitimate operation of this competition may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law.
  49. If the Promoter suffers loss or incurs any costs in connection with any breach of these conditions of entry or any other legal obligation by an entrant, the entrant agrees to indemnify the promoter for those losses, damages and costs.
  50. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting, publicising or marketing this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  51. The winners agree to participate in all reasonable promoted activities in relation to the Competition as requested by the Promoter and its agents.
  52. All trivia questions, entries and any copyright subsisting in the trivia questions and entries become and remain the property of the Promoter. The Promoter collects personal information about entrants to include entrants in the competition and where appropriate award prizes. If the personal information requested is not provided, the entrant may not participate in the competition. By participating in the competition, each entrant also acknowledges that a further primary purpose for collection of entrants’ personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact entrants in the future with information on special offers or provide entrants with marketing materials via any medium including mail, telephone and commercial electronic messages. The Promoter may share information with its Australian related companies and promotional partners who may contact entrants with special offers in this way. By entering the competition, each entrant agrees that the Promoter may use entrants’ personal information in this manner. Each entrant also agrees that the Promoter may publish or cause to be published the winner’s name, and locality in any media and upon the Promoter’s website. Entrants can also gain access to, update or correct any personal information by contacting the Promoter by Telephone: 1300 730 368; or by emailing support at support@wizquiz.com.au or by going to www.wizquiz.com.au and selecting the “contact us” tab of the website.
  53. All personal information will be stored at the office of the Promoter. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter.
